AGREEMENT TO OUR LEGAL TERMS

We are Gloss & Bow, LLC ("Company," "we," "us," "our"), a company registered in the United States at 123 Main St, Anytown, USA.

We operate the website https://glossandbow.com (the "Site") and related products and services that reference these Legal Terms (collectively, the "Services").

Our Services use artificial intelligence to interpret and process user input across several features for adult, entertainment, and creative purposes:

AI Fantasy Generator: Creates custom stories involving erotica, smut & fantasy elements and NSFW content for adult users.
AI Image Tools: Illustrates scenes and characters in selectable art styles.
AI Audio/Narration: Converts stories into narrated audio using synthetic voices.

These Legal Terms form a binding agreement between you and Gloss & Bow, LLC regarding your access to and use of the Services. By accessing the Services, you agree you have read, understood, and will be bound by these Legal Terms. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

We will notify you of material changes to these Legal Terms. Changes take effect upon posting or notice to you (e.g., email from hi@glossandbow.com). Your continued use after the effective date means you accept the updated terms.

Age restriction. The Services are intended for adults 18+ (or the age of majority in your jurisdiction). Persons under 18 may not use or register for the Services.

We recommend printing or saving a copy of these Legal Terms for your records.

1. OUR SERVICES

The Services may not be available or lawful in all jurisdictions. If you access the Services from outside the United States, you do so on your own initiative and are solely responsible for compliance with local laws.

The Services are not designed for industry-specific compliance regimes (e.g., HIPAA, FISMA, GLBA). Do not use the Services in any way that would trigger those regulatory requirements.

2. INTELLECTUAL PROPERTY RIGHTS

Our Intellectual Property

We (or our licensors) own all intellectual property rights in the Services, including source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, and other materials (collectively, the "Content"), as well as the trademarks, service marks, and logos (the "Marks"). Content and Marks are protected by copyright, trademark, and other laws worldwide. Content and Marks are provided "AS IS."

Free-tier license. We grant free-tier users a limited, non-exclusive, non-transferable, revocable license to access the Services and download/print portions of Content for personal, non-commercial use only.

Paid license. Users who purchase monthly subscriptions or other paid access may receive a limited commercial license to use AI-generated outputs they create (e.g., stories, roleplays, images, audio) for lawful commercial purposes, subject to these Terms and applicable law. This license does not permit reselling our Service or redistributing outputs as a standalone AI generation service.

We may update, refine, or discontinue any AI models or features at any time.

Except as expressly permitted, you may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any part of the Services, Content, or Marks for any unauthorized purpose without our prior written permission. If we grant permission, you must identify us as owner/licensor and keep all proprietary notices intact.

We reserve all rights not expressly granted to you.

Material breach. Any violation of this Section is a material breach and may result in immediate termination of your access.

Your Submissions and Contributions

Submissions (feedback to us). If you send us questions, comments, ideas, or feedback ("Submissions"), you assign to us all intellectual property rights in those Submissions, and we may use them for any lawful purpose without compensation.

Contributions (content you post). When you post content to the Services ("Contributions"), you grant us a worldwide, perpetual, irrevocable, non-exclusive, transferable, royalty-free, fully-paid license to host, use, reproduce, adapt, publish, display, distribute, and create derivative works from your Contributions (including your display name, image, or likeness if associated) for operating, improving, and promoting the Services. You retain ownership of your Contributions.

Generated content & moderation. You retain ownership of your AI outputs. You grant us a non-exclusive, royalty-free license to use your outputs internally (anonymized where feasible) to improve safety systems, moderation, and service quality. We do not sell your outputs or train third-party foundation models with your personal data.

Your responsibility. You represent and warrant that your Submissions/Contributions:

comply with these Terms and applicable law;
do not infringe third-party rights; and
are not confidential.

We may remove or edit Contributions at any time if, in our reasonable opinion, they violate these Terms or are harmful. This includes content involving minors, non-consent, incest, bestiality with real animals, necrophilia, real people/celebrities, copyrighted characters, or unlawful/hateful content. We use automated moderation and may apply manual review (especially for flagged items). Violations may lead to suspension, termination, and/or reports to authorities.

Copyright complaints. See Section 15 (Copyright Infringements).

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

all registration information you submit is true, accurate, current, and complete;
you will maintain and promptly update such information;
you have the legal capacity and agree to these Legal Terms;
you are not a minor in your jurisdiction;
you will not access the Services through automated or non-human means (bots, scripts, etc.);
you will not use the Services for any illegal or unauthorized purpose; and
your use will not violate any applicable law or regulation.

We may suspend or terminate your account for inaccurate information or breaches of these representations.

4. USER REGISTRATION

You may need an account to use certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We may remove, reclaim, or change a username that we deem inappropriate, infringing, or otherwise objectionable.

5. PRODUCTS

All digital products offered through Gloss & Bow (e.g., token bundles, image credits, audio narrations, monthly subscriptions if offered) are subject to availability. We may modify features, limits, or pricing at any time without prior notice.

Prices may vary by region and currency (we apply fair regional pricing). Any promotional offers or bonuses are time-limited and may change or end without notice.

We are not liable to you or any third party for any modification, price change, suspension, or discontinuation of products or features.

6. PURCHASES AND PAYMENT

We accept major payment methods displayed at checkout (e.g., Visa, Mastercard, American Express, Discover, JCB, Diners Club). Payments are processed by our third-party providers.

Accurate billing. You agree to provide current, complete, and accurate billing details and to promptly update them as needed.

Currencies. Charges are made in your local currency where supported; otherwise USD is used.

Taxes. Prices may be exclusive of taxes. Any applicable taxes/fees will be shown at checkout and are your responsibility.

Orders. We may refuse or cancel orders, limit quantities, and restrict purchases that appear fraudulent or for resale.

Tokens. Tokens/credits have no cash value, are non-transferable, and are usable only within Gloss & Bow. Token balances may expire where required by law or stated in the offer.

Subscriptions. We currently operate on one-time purchases (no recurring subscription). If we later offer subscriptions, you'll be able to opt in explicitly and manage or cancel from your account before renewal.

Fair Use. To protect service quality, we may apply reasonable rate limits on AI requests (e.g., story/image/audio generations) and may adjust these limits from time to time.

We reserve the right to correct pricing or display errors, even after an order is submitted.

7. REFUNDS POLICY

We want you to have a great experience. Because our products are digital and may be consumed immediately:

Tokens/credits and monthly subscriptions are generally non-refundable once delivered/used, except where required by law or where we explicitly state otherwise.

If you encounter a technical failure (e.g., generation fails repeatedly) and you have not substantially consumed the purchase, contact hi@glossandbow.com within 30 days, and we'll review a good-faith refund or credit at our discretion.

EU Right of Withdrawal for digital content. By starting to use AI tools immediately after purchase (or by checking a box acknowledging immediate supply), you expressly consent to immediate delivery and waive the statutory right of withdrawal for that digital content. This does not affect any remedies you may have under our internal policy above or under applicable law.

Refunds are not available for:

Used tokens/credits;
Expired or fully consumed monthly subscriptions;
Promotional/bonus token amounts;
Abusive or fraudulent usage.

8. PROHIBITED ACTIVITIES

You agree not to use the Services to:

General misuse

Violate any applicable law, regulation, court order, or these Terms.
Interfere with or disrupt the Services or related networks.
Circumvent, disable, or tamper with security or usage limits.
Copy, clone, or build a competing service using our outputs or interface.
Sell, rent, or transfer your account.
Advertise or promote outside products/services without our written consent.

Content violations

Do not generate, upload, or distribute content that involves:

Minors (anyone under 18) in any sexual context;
Non-consent, sexual assault, or coercion;
Incest, necrophilia, bestiality with real animals, coprophilia, or other dehumanizing content;
Real people (celebrities, private individuals) or copyrighted characters without rights;
Hate speech, unlawful discrimination, or incitement to violence;
Self-harm or suicide encouragement;
Private or confidential information about others.

Technical abuse

Use bots, scrapers, or automated tools without permission.
Upload malware, malicious code, or spam content.
Reverse engineer or attempt to extract source code except where permitted by law.
Systematically scrape or harvest data to make a database or derivative service.

Deceptive/abusive behavior

Impersonate others or misrepresent your identity.
Phish for credentials or sensitive data.
Abuse support channels or harass staff or users.

Violations may result in content removal, account suspension/termination, forfeiture of tokens, and legal action where appropriate.

9. USER GENERATED CONTRIBUTIONS

The Services may allow you to create or share text, images, audio, and other materials ("Contributions"). Depending on feature context, Contributions may be visible to others.

By submitting Contributions, you represent and warrant that you:

Own or have necessary rights to the Contributions and to grant the licenses below;
Do not infringe others' rights or violate law;
Have obtained any required consents/releases for identifiable persons;
Are not submitting misleading, unlawful, hateful, harassing, or obscene material;
Are not posting spam or unauthorized advertising;
Are not posting private/confidential information about others.

Moderation. We use automated moderation and, where needed, human review of flagged content to enforce policies and legal obligations. We may remove Contributions, restrict features, or suspend accounts to protect users and the platform.

10. CONTRIBUTION LICENSE

You retain ownership of your Contributions and AI outputs.

You grant Gloss & Bow a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to host, store, use, reproduce, modify, adapt, translate, publish, display, distribute, and create derivative works from your Contributions for the purposes of operating, improving, securing, and promoting the Services (including organization, indexing, backups, troubleshooting, testing, and safety systems).

Where a Contribution includes your display name or likeness, you grant us the right to use that association solely as reasonably necessary to operate and present the Service (e.g., display in your library or community areas, if enabled).

We may edit or re-categorize Contributions to improve organization and user experience, and we may remove Contributions that violate these Terms or applicable law. We are not obligated to monitor Contributions but may do so at any time.

11. THIRD-PARTY WEBSITES AND CONTENT

The Services may contain links to or embed content from third-party websites, services, or platforms ("Third-Party Websites" and "Third-Party Content"). These are provided solely for your convenience.

We do not own, control, or endorse any Third-Party Websites or Third-Party Content. We do not review or guarantee their accuracy, security, legality, or practices. Once you leave our platform, these Terms no longer apply, and your interactions are governed by the respective third party's terms and privacy policies.

Your decision to interact with Third-Party Websites or Content is at your own risk. We have no responsibility for any loss, harm, or damages arising from such interactions, including any purchases or transactions conducted on third-party platforms.

You agree to hold us harmless from any claims or liabilities arising from your access to or reliance on Third-Party Websites or Content.

12. ADVERTISERS

We may allow advertisers to display ads or promotional content in certain areas of the Services. We provide only the space for such advertisements and do not endorse or assume responsibility for any product, service, or claim made by advertisers.

All transactions or interactions with advertisers are strictly between you and the advertiser.

13. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to:

Monitor the Services for violations of these Terms;
Take legal or technical action against anyone violating the law or these Terms, including reporting them to authorities;
Restrict, limit, or disable access to any content or features to maintain platform security and stability;
Remove or disable files, data, or content that are excessive in size or burdensome to our systems;
Manage the platform in a way that protects our rights, ensures lawful use, and maintains a safe environment for all users.

We may act at our sole discretion without prior notice.

14. PRIVACY POLICY

We care deeply about privacy and security. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.

By using the Services, you agree to be bound by the Privacy Policy, which is incorporated into these Terms.

Hosting & transfers: Our infrastructure is hosted in the United States and the European Union. If you access the Services from another region, you consent to your data being transferred to and processed in these locations, which may have different privacy protections than your jurisdiction.

15. COPYRIGHT INFRINGEMENTS

We respect intellectual property rights and expect users to do the same.

If you believe that material on the Services infringes your copyright, send us a notice that includes:

Your physical or electronic signature;
Identification of the copyrighted work(s);
Identification of the allegedly infringing material (with sufficient detail to locate it on the platform);
Your contact information (name, address, email, phone);
A good-faith statement that the use is not authorized by the copyright owner, its agent, or the law;
A statement, under penalty of perjury, that the notice is accurate and you are authorized to act on behalf of the copyright owner.

Knowingly submitting a false claim may expose you to legal liability.

16. TERM AND TERMINATION

These Terms remain in effect while you use the Services.

We may, at our sole discretion and without notice, suspend or terminate your account and access if you:

Breach these Terms;
Violate applicable law;
Engage in behavior that harms the platform, users, or others.

Upon termination, your right to access the Services ends immediately, and any token balances may be forfeited.

You may not register a new account using your name or a pseudonym after suspension or termination. We also reserve the right to pursue legal remedies.

17. MODIFICATIONS AND INTERRUPTIONS

We may modify, suspend, or discontinue any part of the Services at any time, without liability to you or third parties.

Although we strive for uninterrupted service, we may experience maintenance, outages, or technical issues. We are not liable for any damages resulting from interruptions, delays, or inability to access the Services.

We are not obligated to provide updates, corrections, or continued support for any part of the platform.

18. GOVERNING LAW

These Terms are governed by the laws of United States, excluding conflict of law principles.

If your habitual residence is in the EU, you may benefit from mandatory consumer protection rules of your country of residence.

Both parties agree to submit to the non-exclusive jurisdiction of the courts of Illinois, United States, meaning you may bring a claim either in United States or in your country of residence (if in the EU).

19. DISPUTE RESOLUTION

Informal Negotiations

To reduce legal costs and encourage quick resolution, you and Gloss & Bow agree to attempt informal resolution of any dispute for at least 30 days before initiating arbitration or litigation.

Binding Arbitration

Any dispute that cannot be resolved informally will be resolved by binding arbitration under the Arbitration and Internal Rules of the European Court of Arbitration, located in Tallinn, United States. The language of arbitration will be English. Substantive law: United Statesn law.

Restrictions

No class actions or group arbitration;
Each party resolves disputes individually;
No representative capacity claims.

Exceptions

The above does not apply to:

Enforcement or validity of intellectual property rights;
Allegations of theft, piracy, privacy invasion, or unauthorized use;
Claims for injunctive relief.

20. CORRECTIONS

The Services may contain typographical errors, inaccuracies, or omissions (including product descriptions, pricing, or availability).

We reserve the right to correct any errors or omissions and to update or revise information at any time without prior notice — including after an order or token purchase has been submitted.

We are not responsible for errors caused by third-party integrations, payment providers, or external platforms.

21. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
UNINTERRUPTED OR ERROR-FREE SERVICE;
SECURITY OR RELIABILITY OF GENERATED CONTENT;
ACCURACY OF ANY AI OUTPUT OR THIRD-PARTY CONTENT.

We do not guarantee or endorse any content, product, or service advertised through the platform or linked sites. As with any purchase or interaction online, exercise caution and good judgment.

Gloss & Bow does not provide professional, medical, legal, or therapeutic advice. Content generated through the Services — including erotic, narrative, or fantasy material — is fictional and for entertainment purposes only.

22. LIMITATIONS OF LIABILITY

To the maximum extent permitted by law:

We (including our officers, employees, agents, and affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, loss of goodwill, or service interruption, arising from or related to your use of the Services.

Our total liability to you for any claim will not exceed the amount you paid us (if any) in the six (6) months preceding the claim.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. In such cases, our liability will be limited to the maximum permitted under applicable law.

23. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Gloss & Bow, its affiliates, officers, employees, and partners from and against any claim, loss, liability, demand, or expense (including reasonable legal fees) arising out of:

Your Contributions or content;
Your use of the Services;
Your breach of these Terms;
Your violation of third-party rights (including IP rights);
Any harmful act toward another user.

We may, at your expense, assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate fully in such defense.

24. USER DATA

We maintain data you transmit to the Services for operational purposes, backups, analytics, and moderation. While we perform routine backups, you are solely responsible for backing up your own content and Contributions.

We are not liable for any loss or corruption of data, token balances, generated content, or account information, and you waive any claim against us arising from such incidents.

25. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By using the Services, sending us emails, or completing online forms, you consent to receiving electronic communications from us.

You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

You consent to the use of electronic signatures, orders, and records and waive any rights requiring physical signatures or paper documentation.

27. MISCELLANEOUS

These Terms, together with any policies or guidelines posted on the Services (including our Privacy Policy and Content Guidelines), constitute the entire agreement between you and Gloss & Bow.

Our failure to enforce any provision is not a waiver of our rights.
We may assign our rights and obligations to others at any time.
We are not responsible for delays or failures caused by events beyond our control.
If any provision is held unlawful or unenforceable, it will be severed and the remaining provisions will remain in full force.
There is no partnership, joint venture, or employment relationship created by these Terms.
These Terms will not be construed against us by virtue of having drafted them.
You waive any defenses related to the electronic form of these Terms.

28. USER CONDUCT

Gloss & Bow is a platform built on trust, consent, and respect. By using the Services, you agree to:

Acknowledge erotic content

You understand that Gloss & Bow contains erotic stories, sounds, and imagery of a sexual nature. If such material offends or discomforts you, you agree to leave the platform immediately.

Respect community standards

You are solely responsible for ensuring that accessing, creating, or sharing erotic content complies with the laws, norms, and standards of your jurisdiction or community.

Act responsibly

No harassment, exploitation, impersonation, or other abusive conduct. This includes any form of referral fraud, system manipulation, or harassment of other users.

Honor consent and boundaries

Absolutely no content involving non-consensual acts, real-world abuse, or sexualized depictions of minors.

Protect intellectual property and privacy

Only share content you own or are authorized to use, and never share another person's private information without permission.

Play fair

No cheating systems, scraping, reverse engineering, or bypassing platform controls.

Violation of these standards may result in suspension or permanent termination of your account without refund.

29. PLATFORM RIGHTS

To maintain a safe, lawful, and functional platform, Gloss & Bow reserves the right to:

Refuse, restrict, or terminate access to users, accounts, or content at our discretion.
Remove, edit, or disable content that violates our policies, community guidelines, or applicable law — with or without notice.
Enforce moderation flexibly, including AI-powered and human moderation. Some areas of the platform may contain unmoderated user-generated content. We are not responsible for user-submitted material.
Update or modify Services and policies at any time, including features, pricing, or moderation practices.
Enforce usage limits and Fair Use policies to maintain stable performance and prevent abuse.
Preserve or disclose data when legally required or necessary to protect the rights, safety, or property of others.
Protect ourselves legally — by using the platform, you agree not to hold Gloss & Bow responsible for any content you choose to view, read, or create.

We may exercise these rights at any time to protect users, comply with laws, and maintain platform integrity.
